Texas Official Rules – Texas Future Farmers Of America (FFA)
Justin® Boot Stem Contest
No purchase necessary to enter or win. open to legal residents of Texas who are at least 13 years of age.
Entrants under the age of 18 must have permission from their parent or legal guardian in order to enter. A prize won by a minor will be awarded in the name of said minor’s parent or legal guardian.
Entry in this contest constitutes your unconditional acceptance of these official rules.
Sponsor: This Contest is sponsored by Justin Brands, Inc. (“Justin Boots” or “Sponsor”), a Delaware corporation, with its principal place of business at 610 W. Daggett Avenue, Fort Worth, Texas 76104.
Eligibility: The Justin Boots STEM Contest is open and offered only to high school age students resident in the state of Texas (“Students”). Do not participate if you are not a high school age student and a resident of the state of Texas. Employees, officers and directors (and their immediate families defined as parents, children, siblings, spouse) of Justin, its parent company, subsidiaries, divisions, affiliates, and agencies (as applicable), are not eligible.
Entry Period: The Justin Boots STEM Contest entry period begins at 8 AM (CST) Monday, March 22, 2021 and ends at 11:59 PM (CST) Tuesday, June 1, 2021.
How to Enter: To enter this Contest, Students must submit their Justin STEM Contest video and sign up information by visiting Justin FFA Stem Contest between 8 AM (CST) Monday, March 22, 2021 and 11:59 PM (CST) Tuesday, June 1, 2021.
You Must Follow These Four (4) Steps:
2. Enter your first name, last name, email address, phone number, Texas FFA Area (see attached diagram to find the FFA Area where your are located), school, teacher, grade, Facebook user ID and Instagram username.
3. Upload your Justin Boots STEM Contest video in mp4 format.
4. Click 'Submit' button.
All four steps must be completed for entry to be valid.
Video Submission Requirements: Entries that do not meet the following “Requirements” are subject to disqualification, at Sponsor’s sole and absolute discretion:
• The video must be a single work of original material and suitable for presentation in a public forum.
• The video must be under two (2) minutes.
• The video must be in MP4 format.
• The video must highlight a STEM-related project the Student is or has worked on, alone or as part of a Student group.
Except for materials in the public domain, videos must not infringe on the intellectual property rights of any other person or entity. Sponsor does not permit the infringement of others’ rights and any use of materials not original to the entrant is grounds for disqualification from the Contest.
The video must not include material that: (a) is sexually explicit, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous, (b) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (c) invades the privacy or publicity rights of any person, living or deceased, (d) is unlawful, (e) is harmful to other users of the Contest website such as viruses, trojan horses or other technologies that could adversely impact the Contest, and/or (f) is disparaging to Sponsor or is inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate (at Sponsor’s sole and absolute discretion).
Only one (1) entry per person permitted during the entry period.
Prize Winner Selection / Notification: There will be eight (8) prize winners (the “Prize Winners”) selected among all of the eligible entries received during the contest entry period. Valid Student entries will be scored by a panel of five (5) judges selected by Sponsor between Sunday, May 16, 2021 and Friday, June 25. The judges will select one finalist from each Texas FFA Area that represents each category of STEM (Science, Technology, Engineering, Mathematics) to advance to the final round. From there, the panel of judges will select one finalist for all of the Texas FFA Areas that represents each category of STEM (Science, Technology, Engineering, Mathematics). The panel of five (5) judges will determine the final four Prize Winners.
You are not a winner until validated. Sponsor will make up to two (2) attempts over the two (2) days following the Prize Winners’ selection to contact each potential Prize Winner via a message back to the email address which the Prize Winner submitted as part of the sign up for the Contest. If a potential Prize Winner cannot be reached during the forty eight (48) hour period in which he/she is contacted (or if a Prize Winner is found to be ineligible or has not complied with these Official Rules), then the potential Prize Winner will be disqualified and an alternate Prize Winner will be selected from among the remaining finalists from the Texas FFA Areas.
Prize Winners will be recognized at the Texas FFA State Convention.
Sponsor will not be responsible for any potential prize winner’s failure to respond within the requisite timeframe.
Prize; Claiming Your Prize: Each Prize Winner and his or her designated teacher will be entitled to receive one (1) pair of Justin Boots of their choice up to $799 in retail value, one (1) Justin Boots t-shirt of their choice up to $25 in retail value, and one (1) cap of their choice up to $25 in retail value. The approximate retail value (ARV) of all prizes is $6800.00. Each Prize Winner will be required to email his/her name, identify his/her Justin Boot selection, boot size, t-shirt size, cap size, shipping address (only in the continental United States) and telephone number to Marketing@JustinBrands.com on or before 5 PM (CST) on Friday, July 9, 2021. All selections are subject to availability.
General Prize Terms: The value of a Prize will be taxable to Prize Winner as income. Taxes (if any) on a Prize are the winner’s sole responsibility. An IRS Form 1099 will be issued in the name of each Prize Winner or his/her parent or legal guardian for the actual value of the prize received. Upon entry into the Contest, the Prize Winner (as well as all other entrants) is required to comply with any and all applicable federal, state, and local laws. The Sponsor shall have no responsibility or obligation to a Prize Winner or a potential Prize Winner who is unable or unavailable to accept or utilize the Prize as described herein. Only the listed Prizes will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Sponsor reserves the right at its sole discretion to substitute a Prize with another prize of equal or greater value in the event that the advertised Prize is not available. The Prize may not be transferred, conveyed, assigned, or auctioned to any other person.
Publicity: By submitting an entry to Sponsor, entrant (i) waives any and all rights in and to any material submitted by entrant in connection with this Contest (including all moral and other rights of authorship); (ii) hereby acknowledges and agrees that entries (including material submitted by entrant in connection with the Contest) become Sponsor's property and will not be returned; and (iii) grants, transfers and conveys to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license and the absolute right to edit, reproduce, modify, publish, exploit, create derivative works from, display in whole or in part, and use an entry, voice, actions, likeness, name, appearance, biographical material, written works, and all other information or materials that entrant has provided or may provide in connection with this Contest, and the right to secure copyright registrations thereto in perpetuity, including, without limitation, the right to use the entry, in whole or in part, for any and all purposes and in any form, media or technology, now known or hereafter devised, and in any manner including for promotional, marketing and commercial purposes, without further approval, permission or consideration, throughout the universe in perpetuity without additional compensation, notification or permission. Sponsor is under no obligation to use an entry.
General Terms: Noncompliance with any of these Official Rules may result in disqualification. The Sponsor assumes no responsibility for incorrect or inaccurate entry information whether caused by equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail service, or traffic congestion on the Internet or at any web site, or any combination thereof, including, without limitation, any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in this Contest. The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the Prize and Prize Winner. If, for any reason, the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right in its sole discretion to cancel, terminate, or modify the Contest and select a winner from among all eligible entries received up until and or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by the Sponsor. All interpretations of these Official Rules and decisions by the Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted.
Any attempt by any entrant to deliberately damage any web site or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.
Governing Law / Limitation of Liability:
The Connecticut courts (state and federal) shall have sole jurisdiction of any controversies regarding the contest and the laws of the state of Connecticut shall govern the contest. Each entrant/participant waives any and all objections to jurisdiction and venue in those courts and hereby submits to the jurisdiction of those courts.
Any and all claims made by any entrant or participant in the contest shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorneys’ fees. Under no circumstances will entrant [or entrant’s parent or legal guardian] be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Indemnification: Entrants agree to indemnify and hold harmless Sponsor (the "Released Parties") from any and all liability, loss or damage or other liability of any kind (including attorneys’ fees) to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from the acceptance, use of or any participation in the Contest, to release all rights to bring any claim, action or proceeding against the Released Parties, or any one of them, and hereby acknowledge that said Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize.
Winner’s List: The name of the prize winner(s) may be obtained at any time during the Entry Period and no later than 30 days following the Entry Period by sending a self-addressed stamped envelope to: Justin Brands, Inc., 610 W. Daggett Avenue, Fort Worth, Texas 76104, Attn: The Contest Administrator.
